Liability and Warranty

In no event shall we be liable for any damages including, but not limited to any damages or losses arising from the use or inability to use our products. Our products are provided “as is” without warranty of any kind. For plugins reliant on calculations such as our stamp duty or mortgage calculators, the calculations are provided as a guide/illustrative use only and should not be used to make binding financial and legal decisions. We give no warranty that our products will work with your or your clients hardware/software configuration and you agree to take full responsibility for ensuring that you meet all requirements for using our products, including but not limited to, the WordPress requirements.

Licensing

In all WordPress based plugins, the PHP code that directly uses WordPress functions within the product is licensed under the GNU general public license. The design, CSS, HTML, media and PHP code that doesn’t rely on WordPress functions are all copyrighted either by Simon North or the individual creators of the scripts or media used. Products that are not WordPress based are copyrighted by Simon North or the individual creators of any work used in those projects.

Unless otherwise stated you are purchasing the plugin for use on one domain, therefore support and updates will only be available for the domain you have purchased the plugin for. You may not directly or indirectly sell or redistribute our products. If you have purchased a license on behalf of a client, you may re-coup the cost of the license from your client or charge for integration of the plugin.

Ownership

You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified and you must leave intact any copyright notices within the product’s core code. Some of our plugins are provided on a white-label basis, in this case there may be copyright notices or identifiable information within the code still.

Fair Use

Some of our plugins have ancillary services which may be subject to fair use.

Support for plugins with monthly or yearly support and updates payments

Some of our plugins come with a monthly or yearly support and updates payment. In this case, support is provided in order to get the plugin setup on your website and to keep the plugin in working condition for the duration of each support and updates payment period. If you fail to purchase the support and updates then we no longer provide support or updates for the plugin to your website. The yearly support and updates payment is usually less than the initial payment, as such, if you do not purchase a package for the time you need it then we reserve the right to charge the initial full payment for the plugin again to receive the support.

Updates will be provided automatically through the Plugins page in your WordPress admin area when we issue an update to the plugin. An update can be issued for any reason, but is usually because there is a change in WordPress or with an ancillary service such as an API. We may also issue updates to add features to the plugin to enhance its offering. When an update is available, so long as you have the license key set in your options page and you are currently within a period where you have paid the support and updates fee, you should see the option to update the plugin. We do not update the plugin on your behalf. If you wish for us to update it for you then you can contact us to arrange this and subject to having the correct access details, we will update it for you and check that it is working as expected.

We regularly check information sources that feed our plugins, for example the calculations behind stamp duty or the API documentation behind our Spektrix plugin to ensure that we’re keeping ahead of any changes and release updates asap once we become aware of any changes. We also regularly test our plugins with new releases of WordPress and PHP to ensure that they are continuing to work as they should.

Should the plugin fail, and you are within your support and updates period, you can email us on simon@devupnorth.co.uk with an explanation of the issue. Subject to us having the correct access details, we will investigate the issue for you and advise on what could have caused the failure and if the failure is with our plugin then we issue a fix for the issue and get the plugin working as expected. If the failure is due to an external factor, such as another WordPress plugin or theme or server issue, then we reserve the right to charge additional fees for rectifying the issue or advise that you need to contact the other party to solve the issue. If we need to charge additional fees, these will be quoted and outlined to you prior to any work taking place.

Support is provided between normal office hours, Monday – Friday 9am – 5pm via email only. From time to time, we may be able to offer a call for screen sharing purposes but this is at our discretion. Although we make no guarantee on specific timeframes for response and resolutions, we aim to respond promptly to any support request, normally within 24 hours of an urgent issue, or 3 working days for a general issue or query. Urgent issues relate to a plugin’s main function failing, for example a calculation not calculating or events/properties not showing on your website in an API plugin. The time it takes to resolve the issue depends on the issue in question and our access to your website.

For our Spektrix and Property Management Software Integration plugins, we offer an additional service where we set up a cron job to provide a consistent time based check against new events/properties to ensure that your website is updating them. We offer this service because most WordPress sites’ built-in cron manager isn’t reliable enough to ensure smooth integration between the API and the website. Should the support and updates fee not be paid, we will turn off this additional service and you’ll need to ensure that you remove the license key from the options page of the plugin so that the site defaults back to the WordPress cron manager otherwise events/properties will stop importing.

One month before the fee is due, we will send an email and invoice to you to request the payment of the fee. The invoice will need to be paid prior to the anniversary date for the new year of support and updates to take effect. We reserve the right to amend the cost of our yearly fees at at any time, should we need to do this then we will write to the license holder within 30 days of the new price taking effect.

You are free to cancel the support and updates at any time by not renewing the fee, at which point support and updates will end at the end of the current paid period. We do not refund for any unused time for the period.

Support for plugins without a monthly or yearly support and updates payment

Some of our plugins don’t require an additional payment for support and updates, this is because they often don’t need to be regularly updated, such as our mortgage calculator plugin. Some of our plugins have a calculation update payment, so that you only need to pay for the update when an update is available. For these plugins, support is provided for the first year to ensure that the plugin is working as expected on your website. After that it is at our discretion and will be determined on a case-by-case basis.

Rescinding support

We reserve the right to rescind support and updates at any time if we feel that the process is being abused, the website that the plugin is being used on is illegal or doesn’t align with our values, our staff are been treated unfairly or for any other reason. If terminating the support and updates contract, we may refund the current period’s payment if appropriate.

Payments

If purchasing the plugin or service via the website then you can make payment with a credit/debit card or your PayPal account. If paying via invoice, then you’ll received the invoice via email and can make payment via BACS. DevUpNorth is a trading style of Simon North, a sole trader registered in the UK. No VAT is charged on any payments as the business is under the threshold for VAT collection and remittance. You may not purchase a plugin or service or engage in work with Simon North if you are based outside the United Kingdom. A valid UK address and UK credit card/debit card/bank account/PayPal account will be required to make any payments.

Refunds

As our products are non-tangible digital products, it is completely at our discretion as to whether we will provide a refund, you will only receive a refund if the product is not as described, doesn’t work on your website, or is broken or corrupt and if you have issued a refund request within 30 days of purchase and worked with us to rectify any issues.

Delivery of Files

Once payment has been completed you will have access to the plugin file to download and install on your website.
